Behlau Murakami Grant's Jason Murakami is a former press journalist, who's reputation in defamation proceedings saw him acting for Ben Roberts-Smith's estranged wife Ms Emma Roberts in his defamation proceedings against Channel 9-Fairfax dubbed the defamation trial of the century.
Ben Robert Smith sued Nine newspapers for a series of articles. In early June 2023 Federal Court Judge Besanko handed down his decision finding for Channel 9 Fairfax.
Mr Roberts-Smith and Ms Roberts separated in 2020 as his separation worked through the Federal Court. He launched a second lawsuit in mid-2021, against his former wife, accusing her of accessing his private emails to Nine either personally or through her best friend. Ms Roberts denied his claims and Behlau Murakami Grant successfully defended this allegation for her.
Federal Court Judge Bromwich, in January 2022, accepted Ms Roberts‘ denials and ruled Mr Roberts-Smith’s lawyers could not cross-examine her in the stand. On appeal, Behlau Murakami Grant were again successful before Justice Wigney, who affirmed the decision to refuse the soldier‘s bid to cross-examine his ex-wife.
